![]() I'm sure many of the responses or opinions about this will be "so what? just play the game" - but what is concerning to me is that my point of view wasn't even worth Real Welder's (the developer's company that was only registered this month) time to issue a response. Are you intending on fulfilling the commitment made in your sales information or not? Your product is marketed as 'Early Access' and that ' it will be better if you wait for the official release.' yet your EULA states that updates, bug fixes, and improvements are not guaranteed. It is The Company's contention that it can sell licenses, receive the money from these sales, and then revoke those licenses at any time and without penalty?ĥ. You state that the license is revocable but do not mention any consequence of The Company doing so. This qualifies as unconscionable conduct under Australian law.Ĥ. ![]() You mention that by agreeing, I also agree to any terms of third-party services - you don't identify any third parties or provide reference to their terms. Why do you not permit me to copy the EULA?ģ. If I don't accept the EULA, do you agree to provide a full refund?Ģ. I note that there is now a EULA that requires my agreement to, before I am allowed to play I have some issues with this.ġ. Today was the first time in a while that I've played as I've been awaiting updates to the game from yourself. It has been 5 full days and no response has been received.Īs you can see from the attached email, I bought your game in November last year. There were a number of issues in this contract that I too issue with and so, just as indicated in the EULA, I sent an email to the developer. I, unlike so many others, read what I am putting my signature to and this was no exception. I noticed that there is a now a End User License Agreement that I must agree to before playing a game. Monday 15 March I decided to check out the latest updates and fired up Sky Haven.
